SUPREME COURT EMPOWERS TRUMP ADMINISTRATION TO DEPORT 350,000 HAITIANS WHO HAVE TEMPORARY PROTECTED STATUS (TPS)
What Is TPS? TPS was created by Congress to allow foreign nationals from designated countries to live and work in the U.S. temporarily due to unsafe conditions — armed conflict or environmental disaster — preventing safe return home. Trump vowed to end the TPS program while making highly publicized, openly racist, hateful and false statements about Haitians and all immigrants. The Supreme Court just gave him the go-ahead.
What’s Happening Now?
Originally, TPS for Haiti was to end in February, 2026, but the DHS ruling has been on appeal in the courts. Now, the Supreme Court has given Trump broad license to carry out his racist, anti-Black, anti-immigrant program, ruling that DHS can strip Haitians – as well as Syrians – of Temporary Protected Status. This, despite the fact that the State Department tells Americans not to travel to Haiti because of dangerous conditions. In the last year alone, over 8,000 Haitians have been killed, primarily by death squads, and 1.5 million Haitians have had to flee their homes.
This decision could leave 350,000 Haitian, and 6,100 Syrian TPS holders without work permits, subject to Trump’s brutal detention/deportation machine in what would be one of the largest mass deportations in US history. Fifteen other country nationals with TPS are at risk of being subjected to the same draconian measures. The decision harms Haitians and all TPS holders who have built lives here and have become pillars of their communities. But the fight is not over!
WHAT YOU CAN DO
Congress needs to act! The House passed HR 1689 which would extend TPS for Haitians for the next three years until 2029. This bill has now been taken up with Senate bill S4814. So far, neither Senator Schiff nor Padilla has joined the 19 others who have co-sponsored this bill.
